All Build HR YOUR Way is the intellectual property of Alicia Williams. You are acknowledging and agreeing (under Maryland law and venue) that any sort of course or academy that you might put together that teaches the same lessons contained in Build HR YOUR Way, would be unoriginal and that you would assign such so it is actually the property of Humanity in HR LLC and Alicia Williams, or its successor in interest. If you create something that competes with Build HR YOUR Way, with the same or similar content, any income derived from that product would legally belong to Alicia Williams. If those proceeds are not surrendered upon demand, and a judgment is awarded in favor of Alicia Williams, you’ll have to pay for all the lawyers, and fees, along with all proceeds received, and $10,000.00 in liquidated damages for dilution of the Build HR YOUR Way role in the online business education marketplace.
Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Build HR YOUR Way and Humanity in HR websites operated by Humanity in HR LLC (“Company”, "us", "we", or "our"), and Kajabi, Inc., as well as a private/”secret” Facebook group hosted by Facebook, Inc. and administered by Humanity in HR LLC (together with the websites, such access and any appurtenant educational opportunities constitute the "Service").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service, and any violation of these terms or other terms posted in relation to or preceding your use of the Service, shall incur costs and penalties including loss of use of the Service as well as possible further financial costs and legal repercussions.

a. Permission is granted to temporarily download one copy of the downloadable materials (information or software), or access any non-downloadable material on Company’s or Kajabi’s sites for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

ii. use the materials for any commercial purpose, or for any public display or other repetition (commercial or non-commercial);
iii. attempt to decompile or reverse engineer any software contained on Company's or Kajabi’s website;
iiii. remove any copyright or other proprietary notations from the materials; or
v. transfer the materials to another person or 'mirror' the materials on any other server.
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Humanity in HR LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Humanity in HR LLC.
b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
In no event shall Company or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Company's Internet site, even if Company or a Company authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
4. Revisions and Errata
The materials appearing on Company's web site could include technical, typographical, or photographic errors. Company does not warrant that any of the materials on its web site are accurate, complete, or current. Company may make changes to the materials contained on its web site at any time without notice. Company does not, however, make any commitment to update the materials.
Company has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Company of the site. Use of any such linked web site is at the user's own risk.
By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
7. Refund Requests
There are no refunds either partial or whole for intellectual property thus Humanity in HR LLC will not grant refunds.
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
You may not assign your rights or obligations to another person or entity without the express written agreement of Humanity in HR LLC. However, Humanity in HR LLC may assign duties and benefits exclusively to a successor in interest, i.e., from itself to another LLC or Corporation. If this Agreement is assigned or otherwise transferred, it shall be binding on all successors and assigns.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.
By posting Content on or through the Service, You represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. Humanity in HR LLC has the right but not the obligation to monitor and edit all Content provided by users.

Humanity in HR LLC may add, update, and remove any content to or from the Service at its sole discretion, without notice to any party.
You agree to defend, indemnify and hold harmless Humanity in HR LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NEITHER HUMANITY IN HR LLC, NOR ITS SUBSIDIARIES, AFFILIATES, OR LICENSORS WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
14. Governing Law
Any claim relating to Company's web site shall be governed by the laws of the State of Maryland without regard to its conflict of law provisions. Company’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
